يرتبط قانون الأصول مع قانون العقوبات برابطة وثيقة إذ يكمل أحدهما الآخر، فإذا كان قانون العقوبات يعني بقواعد التجريم والعقاب وفقا لمبدأ قانونية الجريمة والعقاب (مبدأ الشرعية)، فإن قانون الأصول يبحث في مدى توفر شروط التجريم والعقاب وفق إجراءات قانونية، بمعنى آخر مدى قانونية التجريم والعقاب أثناء مرحلة التحقيق والمحاكمة وتنفيذ العقوبة إن تحققت الإدانة. فهو يضمن تحقق الغاية والحكمة من التجريم والعقاب وضمان أن الحرية الفردية لن تهدر أثناء التحقيق والمحاكمة حتى لو جاء ذلك الهدر في الحقيقة من القاضي الذي يطبق قانون العقوبات بما يتضمنه قانون الأصول من قيود على إرادة القاضي وسلطته التقديرية، وحول هذه الضمانات، وفي نطاق سلسلة مؤلفات مراحل الدعوى الجنائية وحقوق المتهم في كل مرحلة من هذه المراحل.
