يتناول هذا الكتاب نظرية الفاعل المعنوي بين الفقه الإسلامي والقانون الوضعي حيث يكون من اليسير معرفة فاعل الجريمة إذا ارتكبها بنفسه وظهر على مسرحها ولكن تكمن الخطورة ويصعب الأمر إذا كان هذا الفاعل لا يرتكب الجريمة بنفسه وإنما يحققها عن طريق شخص آخر فيستغل سذاجة صبي غير مميز أو مجنون أو يستغل براءة شخص حسن النية أو حيوان ويجعلهم أداة له في تحقيق الجريمة وهذا المستغل هو ما يسميه فقهاء القانون الجنائي بالفاعل المعنوي.
