Children, Autonomy and the Courts

\"This book arises out of a CRC Implementation Project colloquium on Article 5 of the UN Convention on the Rights of the Child. Article 5 protects the responsibilities, rights and duties of parents or others to provide, in a manner consistent with the evolving capacities of the child, appropriate direction and guidance in the exercise by the child of his/her rights. In this interdisciplinary collection, leading international scholars address the interplay of parental guidance, state responsibility and child autonomy within a wide range of fields, from gender identity to criminal justice. The chapters provide fascinating insights into the vital but enigmatic role of Article 5\"-- Provided by publisher.

This volume provides a series of critical analyses of some of the contemporary debates in relation to the human rights of children, resituating them within visions which informed the text of the United Nations Convention on the Rights of the Child in 1989. The studies embrace examination of some of today's widespread interpretations of the CRC, analysis of what is implied by a human rights-based approach in research and advocacy and consideration of advances and barriers to research and to several aspects of CRC implementation. With contributions by leading experts in the field, the book examines the CRC as an international instrument, its inherent dilemmas and some of the debates generated by the challenges of implementation. It embraces examinations of different levels of governance from the international to the state party, regional and local levels, including institutional developments and changes in law, policy and practice. The book will be a valuable resource for students, researchers and policy-makers working in the area of children's rights and welfare.

Global norms with a local face : rule-of-law promotion and norm-translation
\"To what extent are global rule-of-law norms, which external actors promote in post-conflict states, localized? Who decides whether global standards or local particularities prevail? This book offers a new approach to the debate about how the dilemma between the diffusion of global norms and their localization is dealt with in global politics. Studying the promotion of children's rights, access to public information, and an international commission against impunity in Guatemala, Lisbeth Zimmermann demonstrates that rule-of-law promotion triggers domestic contestation and thereby changes the approach taken by external actors, and ultimately the manner in which global norms are translated. However, the leeway in local translation is determined by the precision of global norms. Based on an innovative theoretical approach and an in-depth study of rule-of-law translation, Zimmermann argues for a shift in norm promotion from context sensitivity to democratic appropriation, speaking to scholars of international relations, peacebuilding, democratization studies, international law, and political theory\"-- Provided by publisher.
