يتجلى موضوع نظرية الالتزام فيما يطلق عليه الحق الشخصي وهو الوجه الذي يمثل طرف الدائن باعتباره الوجه الإيجابي، وحينما ينظر إلى العلاقة القانونية من جهة المدين يطلق مصطلح (الالتزام) باعتباره الوجه السلبي لهذه العلاقة وهذه المصطلحات مأخوذة عن الفقه الغربي الذي يجد جذوره التاريخية في القانون الروماني، أما الفقه الإسلامي فلم يرد فيه هذا المعنى لفكرة الحق الشخصي لأن لفظ الحق فيه ينصرف إلى جميع الحقوق المالية وغير المالية، فيقال حق الله وحق العبد ويستعمل الفقهاء المسلمون لفظ \"الحقوق\"، ويريدون به في حالات حقوق الارتفاق، وفي حالات أخرى ما ينشأ عن العقد من التزامات غير الالتزام الذي يعتبر حكم العقد، فعقد البيع حكمه نقل ملكية المبيع وحقوقه تسليم المبيع ودفع الثمن.
