تعتبر الحماية الجنائية للآثار واحدة من أهم موضوعات القانون الجنائي لكون مصر زاخرة بكم هائل من الآثار فهي تحوي أكثر من ثلث آثار العالم. ويقصد بالآثار نتاج الإنسان القديم ذو القيمة التاريخية أو العلمية أو الفنية وتتناول هذه الدراسة الحماية الجنائية للآثار في قسمين : القسم الأول يعالج الأحكام الموضوعية لجرائم الاعتداء على الآثار وينقسم بدوره إلى بابين : الأول يبين النظرية العامة للجريمة الأثرية، والثاني يعرض صور الجريمة الأثرية، القسم الثاني بينا فيه الأحكام الإجرائية الخاصة بجرائم الاعتداء على الآثار وقد شمل هذا الجزء بابين : الأول خصصناه للأحكام المتعلقة بمرحلتي الاستدلال والتحقيق الابتدائي، والثاني عرضنا فيه مرحلة المحاكمة.
