Overview
فقه المآلات وليس فقه المعاملات كما قد يظن البعض، هي مفهوم موجود ومطبق في الفقه والتاريخ الإسلامي. والغزالي إعادة اكتشافه ثم قام بعرض المفهوم بالكامل وبيان أهميته في الفتوى. ولقد مرت قرون على كتاب الموافقات وتوجد مراجع عربية بين حينة وأخرى حول هذا المفهوم، ولكن بالنسبة للجانب الإنجليزي فالمراجع نادرة جدا. الهدف من هذا البحث هو ربط المفهوم مع مقاصد الشريعة وبيان علاقته بها وبيان نوع هذه العلاقة. حيث ولقد تم استخدام المنهج الوصفي في هذا البحث.
