يدرس هذا البحث مسألة متعلقة بالشهادة وهي، تقادم الشهادة وأثره في إسقاط الحدود، حيث يبين معنى التقادم، أنه: مضي زمان يحدده الحاكم على عدم أداء البينة فيما لا يحتاج إلى دعوى. وكذلك يبين آراء الفقهاء في سقوط الحد عن المشهود عليه، ويصل إلى أن تقادم الشهادة لغير عذر يسقط الحد عن المشهود عليه، لأن مجيء الشاهد للإخبار عما شاهد بعد زمان يورث شبهة في شهادته، تستوجب الرد، وعندها يسقط الحد، لأن الحدود تسقط مع الشبهة. أما ما يتعلق بمدة التقادم وتقدير الأعذار، فإنها تترك للسلطة التقديرية للحاكم، لعدم ورود نص في ذلك، فيكون -التقدير-خاضعا بحسب الظروف والأحوال، والأزمان.
