يطرح مبدأ الأثر غير الموقف للطعن بالنقض في الأحكام المدنية إشكالية الآثار السلبية المترتبة عن احتمال عدم إمكانية إرجاع الحال إلى ما كان عليه في حالة نقض تلك الأحكام واحتمال المساس بحقوق الغير، لذلك فإن التفكير في إعادة النظر في حدود تطبيق هذا المبدأ يعد مسألة جديرة بالبحث، حيث نحاول من خلال هذا المقال أن نبحث في مدى عدالة تغليب الأثر غير الموقف للطعن بالنقض على الأثر الموقف، وهل يجب إعادة النظر في تحديد نطاق تطبيق الأثر الموقف للطعن بالنقض عن طريق التوسع فيه.
