منهج ابن حبيب في ذكر المسائل فإنه يستهل المسائل بما ورد فيها من آيات بينات، ثم يتبعها بالأحاديث الواردة في القضية التي يتحدث عنها، لثم الآثار، ومن ميزات الكتاب الجميلة أنه يسوق تلك الأحاديث والآثار بإسناده إلى راويه، ثم أقوال العلماء المعتبرين، ثم يذكر رأيه الذي ارتضاه، منتصرا له بالدلائل التي يراها تقوم حجة له وبرهانا، سواء الآيات أو الأحاديث، أو أقوال أهل العلم من متقدمي مذهب المالكية، ثم بعدها يعرض أقوال أهل العلم من المذاهب الأخرى، سالكا المنهج نفسه من الاستدلال والاحتجاج، وهو في كل هذا يوجه ويعلل ويحلل، وقد قال في بعض ذلك: \"سأفسر لك ذلك إن شاء الله نوعا نوعا، ووجها وجها، على ما بلغني علمه، وحضرني فهمه، وما توفيقي إلا بالله\".
