هذا الكتاب محاولة للجواب عن سؤالين مؤرقين لماذا يشتغل الآلاف والآلاف بدراسة أصول الفقه ولا ينتجون فقها ؟ ولماذا لا يهتم دارسو الفقه الإسلامي والباحثون فيه بوقائع الحياة كما يعيشها الناس ويساهمون في تحليل عناصرها واقتراح الحلول الملائمة لتنظيمها ؟ ومن المؤكد أن أسباب جعجعة الدراسات الأصولية دون طحين والإهمال المتعمد لوقائع الحياة المعيشة ترجع إلى خلل أو «عطب قديم» بتعبير الملك عبد الحفيظ في بداية القرن العشرين وفي بعض التصورات المقدمة في دراسات أصول الفقه تمكنت من تعقيم هذه الدراسات وتعطيلها من الإنتاج المرغوب فيه.
