فمن أسباب اختيار موضوع الكتاب، أهميته في العلاقة بين علمي الأصول والفقه، من خلال التأصيل والتطبيق معا، ودون الاقتصار أو التوسع في أحدهما فقط. وقد أدركت هذه الأهمية، منذ بحثي لنيل الإجازة في الدراسات الإسلامية، في موضوع قاعدة الإباحة الأصلية : تأصيل ونماذج، التي تعد إحدى قواعد الاستصحاب الفقهية. لكن القواعد الفقهية المبنية على الاستصحاب، كثيرة يتعذر حصرُها، لتعدد و تنوع قواعده هو أيضا. وما لا يدرك كله لا يترك جله، خصوصا مع اعتماد منهج شمولي يضم الكل. إن بعض هذه القواعد، عامة تدخل في جل أبواب الفقه ولا تَخص بابا واحدا. وبعضها الآخر الأكثر عددا، من القواعد الخاصة بباب أو ببعض الأبواب، بمعنى أنها أقل انتشارا في الأبواب الفقهية.
