جاء إحداث المحاكم الإدارية في المغرب في إطار إرساء دعائم مبدأ الشرعية وتكريس أسس دولة القانون وما يقتضيه ذلك بالضرورة من وضع آليات مؤسساتية وضمان خضوع الإدارة لسيادة القانون وفي إطار العمل على استكمال بناء قضاء إداري متخصص تم إحداث محاكم استئناف إدارية كدرجة ثانية من درجات التقاضي مما أسهم في إعادة الغرفة الإدارية لمحكمة النقض إلى دورها الطبيعي كمحكمة قانون وذلك بعد صدور الظهير الشريف رقم 1.06.07 بتاريخ 16 محرم 1427 (14 فبراير 2006) بتنفيذ القانون رقم 80.03 لتصبح بذلك محاكم الاستئناف الإدارية هي الجهة القضائية الطبيعية المختصة في البت في استئناف الأحكام والأوامر الصادرة عن المحاكم الإدارية ما لم ينص قانون على خلاف ذلك.
