وتكمن المفارقة في أن الأخلاق، وفقا لما يحكم به العقل العملي، والفقهَ لا يترادفان في التفكير الفقهي، بمعنى ألا ضرورة في منطق هذا التفكير لأن تتطابق الفتاوى والأحكام الفقهية مع أحكام العقل الأخلاقي والمعايير القيمية الإنسانية المتفق عليها بين العقلاء، مثل حقوق الإنسان بوصفه إنسانا، وإنما المهم في منطق التفكير الفقهي أن تكون النتائج الفقهية حاكية عن مقدّماتها من القواعدِ الأصولية والفقهية وغيرها من الأدوات المستعملة في استنباط الأحكام بشكل صحيح، وإن كانت مفارقة في مضمونها لمقاصد الشريعة وأهداف الدين وقيمه المعنوية ومعاييره الأخلاقية.
