تعتمد العدالة على عدة قواعد مصدرها الدستور والمعاهدات والقوانين والنصوص التنظيمية والأحكام القضائية التي تتعلق بحلول وضعيات قانونية معينة أما الحق فهو من جهة الملكة التي ممكن الإنسان من استيعاب فعل معين والتمتع بشيء معين والزعم بامتلاكه والمطالبة به وهو من جهة ثانية ما يخول للفرد الاستفادة من شيء ما أو استعماله أو إنتاجه. وهو من جهة ثالثة، وهذا المعنى هو الأهم في سياق الإشكال المعالج، مجموع القواعد والمعايير العامة المنظمة للعلاقات بين الأفراد والتي تحدد وتعرف حقوقهم وصلاحياتهم وهو ما يحدد ما هو إلزامي سواء كان مسموحا به أو ممنوعا ويحيل الحق للقوة بحيث أنه يمكن تطبيقه عن طريق السلطة العمومية المتمثلة في الدولة.
