يحتوي هذا الكتاب على دراسة أعدها الدكتور \"مصطفى الزحيلي\" وفيها تحدث عن المقدمات التي تتصل بالشريعة الإسلامية وعن موقع القضاء منها وصلة القضاء بالدولة في الإسلام نشوء المؤسسات الفضائية كما وقدم موجزا تحدث فيه عن نظام القضاء في الفقه الإسلامي وقدم نماذج وأمثلة من تاريخ القضاء في الإسلام ومن تراث السلف الصالح ولما كانت الدعوى هي الوسيلة الأساسية للوصول إلى الحق المتنازع عليه أو المختلف فيه أو المعتدي عليه فقد خصص المؤلف بابا في الكتاب بحث فيه بموضوع الدعوى تعريفها مشروعيتها وأركانها وشروطها وأنواع الدعاوى وإجراءات النظر فيها والآداب الواجب اتباعها أثناء النظر فيها.
