واحد من أهم أعمال علال الفاسي ضمن مشروعه الإصلاحي ؛ حيث تناول فيه الجانب التشريعي من المشروع. وتتركز إشكالية الكتاب حول سؤال مركزي هو : كيف يمكن لنا اليوم ونحن نعيش زمن التطور-أن نحكم تشريعا نزل منذ ما يزيد عن أربعة عشر قرنا ؟ وللإجابة عنه تناول المؤلف ثلاث قضايا أساسية، هي : أصالة الشريعة الإسلامية، وعناصر صلاحيتها لكل زمان ومكان، ومقاصد القوانين الاستعمارية ؛ ليؤكد على ضرورة استمداد القوانين من الشريعة الإسلامية. إن الفكرة الأساسية لهذا الكتاب تتمثل في ضرورة الانطلاق في بناء نهضتنا من خصوصيتنا الثقافية ؛ لأن الذات معبر إلى العالمية، فلا عالمية لمن بنى نهضته على خصوصية الآخرين.
