تناول الكتاب استعمال الاجتهاد الاستنباطي حيث وجد الفقه، إلى جانب الشرع؛ فالشرع هو ما أخذ من نصوص الوحي كتابا أو سنة، دون أن يكون في هذه النصوص أي احتمال، فهو يتوفر على اليقين؛ بينما الفقه هو ما أخذ من نصوص محتملة، أو اعتمد الاستنباط بواسطة المقاصد والمبادئ والمصادر التبعية للتشريع، مما لا يتوفر فيه اليقين؛ ولقد كان الصحابة يدركون الفرق بين الشرع اليقيني، والفقه الذي يلفه الاحتمال؛ قال أبو بكر الصديق رضي الله عنه في اجتهاده.
