يوضح الكتاب إن حقوق المتهم هي حقوق أصلية وليست عارضة وهذه الحقوق مصدرها الشريعة التي قامت على العدل والإنصاف وإعطاء كل ذي حق حقه مع كل الناس وبهذا نعلم أن الشريعة المستوعبة لم تغفل حقا لذي حق بل جاءت كاملة مراعية للمقاصد محققة واجب الحفظ والزجر بما يضمن التأديب والإصلاح والحق للإنسان منه ما هو واجب مفروض لة ومنه ما هو أمر ثابت طبيعي لة فله إذن حقوق في الحياة باعتباره إنسانا خلقه الله وباعتبار ما له وما عليه إن المحاكمة العادلة هي المحاكمة التي تتضمن أحترام الإجراءات أثناء تطبيق القوانين والتي تحاط بها عدد من الضمانات من شأنها أن تجعل المحاكمة عادلة مثل علنية المحاكمة والمساواة بين الخصوم في الدعوى وغيرها من الضمانات.
