تعد العقود الإدارية أسلوبا مميزا ومهما تمارس الإدارة من خلاله نشاطا إداريا مغلقا بمرفق عام هادفا إلى ضمان استمرارية سير المرفق المذكور بانتظام واضطراد حيث تسلك في ظل هذا الأسلوب منهج الرضا والتفاهم من خلال أبرامها للعقد الإداري وعن طريق الاتفاق مع أحد الأشخاص الطبيعيين أو الاعتباريين وهذا الأسلوب تلجأ إليه الإدارة إذا لم يسعفها القرار الإداري في ممارسة نشاطها أو إذا رأى أن إسلوب العقود الإدارية أقدر على تحقيق أهدافها.
