التنفيذ في اللغة هو تحقيق الشيء وإخراجه من نطاق الفكر والتصور إلى مجال العمل والواقع الملموس، أما في الاصطلاح الفقهي فيقصد به التنفيذ الذي تجريه الستة العامة تحت إشراف القضاء ورقابته بناء على طلب دائن بيده سند مستوف لشروط خاصة بقصد استيفاء حقه الثابت في السند من المدين قهرا عنه. وقد ركز الكتاب على أحكام قانون التنفيذ طبقا للاتجاه الفقهي الجديد وقد سلط الضوء على دراسة نظرية التنفيذ حيث ذكر الأحكام، المستحدثة في قانون التنفيذ رقم 36 لسنة 2002 وتناول الأركان، الموضوعية للتنفيذ الجبري والأركان الإجرائية للتنفيذ الجبري وما ينطوي تحتهما من تقسيمات.
