بحث حدود الحصانة الدبلوماسية في مواجهة الإجراءات الجزائية تعرضنا من خلال أربعة فصول أولهما فصل تمهيدي إلى موضوع حدود الحصانة الدبلوماسية في مواجهة الإجراءات الجزائية، تلك الحصانة التي تعتبر من أھم الحصانات الممنوحة له إن لم تكن أھمھا وذلك طبقا للمادة 31 من اتفاقية فيينا لسنة 1961 التي أشارت إلى تمتع المبعوث الدبلوماسي بالإعفاء من القضاء الجنائي في الدولة المعتمد لديھا ويتمتع كذلك بالإعفاء من القضاء المدني والاداري، ونصت على أنه لا تنصب ھذه الحصانة على إجراءات التقاضي الجزائية للدولة المعتمدة لديھا فحسب بل تمتد لتشمل شخص المبعوث الدبلوماسي حيال الإجراءات الأخرى من حجز وقبض وتفتيش وتحقيق إلى غير ذلك من التعقيبات القانونية التي يجري اتخاذھا في العادة تجاه خرق القوانين الداخلية للدولة المضيفة، وتجدر الإشارة إلى أن من شأن الحصانة الجزائية على ھذا النحو أن تحقق حسن سير المھام الدبلوماسية التي تتطلب إلى حد بعيد تمتع الممثلين الدبلوماسيين بقدر كبير من الحرية والاستقلال.
