سنقوم بدراسة معنى التشريع وشرعية الاجتهاد في الإسلام من منظور سياسي شرعي كأساس لتحليل فقه الدولة في الإسلام، ولبيان كيفية تناول التشريع الإسلامي للواقع السياسي للأمة والدولة : يقرر الإسلام أولا أن إنشاء الشرع ابتداء إنما يختص به الله-تعالى-وحده ؛ فإليه يرجع الأمر والحكم، وليس لمخلوق أن ينشئ حكما بالتحليل أو التحريم ابتداء من عند نفسه، وقد أنكر الله-عز وجل-على من فعل ذلك، وأمر بقتاله، وتوعد من فعله من المشركين الخاسرين المفترين.
