يبين هذا الكتاب في هذا الفصل التطور التاريخي للعلامات التجارية في مرحلة العصور القديمة والعصور الوسطى ومرحلة العصر الحديث والتطور التشريعي لها على الصعيد الوطني والدولي والعربي والأردني مستعرضا التعريف بالعلامة التجارية ووظائفها وأهميتها ثم يميز بين العلامة التجارية والحقوق الفكرية الأخرى وكيفية اختيار العلامة التجارية موضحا عناصرها المسموحة والممنوعة ويعدد الشروط الموضوعية والشكلية للعلامة التجارية والآثار المترتبة على تسجيلها ثم يشير إلى تسجيل العلامة الأجنبية في الأردن وحمايتها وبيان أحكام العلامة التجارية المشهورة ويتناول الحق في العلامة التجارية مبينا مميزات الحق في العلامة التجارية وأسباب كسب الحق فيها وحالة التنازع على ملكيتها والتصرف بها وانقضاء الحق فيها وأما الحماية القانونية منفرد لها مساحة كبيرة إذ يركز على الحماية المدنية للعلامة التجارية والحماية الجزائية.
