يثير موضوع البحث كما يتضح من عنوانه أنه يتعلق بأحد أنماط التحكيم التجاري الدولي ذلك التحكيم الذي يتعلث بطائفة العقود التي تبرمها الدولة مع الأشخاص الأجنبية الخاصة الدائرة في بيئة التجارة الدولية تلك العقود التي يطلق عليها بالعقود الإدارية ذات الصفة الدولية أو عقود الدولة وعقود التنمية الاقتصادية وإن تنوعت الإصطلاحات الفقهيه لهذه العقود إلا أنها تندرج تحت مضمون واحد، وهو أن الدوله أضحت أحد أطراف التجارة الدولية. خصوصا بعد المعيار القانوني لصالح المعيار الاقتصادي في تحديد دولية العقد. وتراجعت أيضا فكرة تجارية العمل أمام رأسماليته.
