تعد النزاعات المسلحة ذات الطابع غير الدولي الصورة الأكثر شيوعا في واقع المجتمع الدولي سابقا وحاضرا للسلم والأمن الدوليين لما تسببه من المعاناة الإنسانية التي تمس فيه الحياة الطبيعية الآمنة للفرد داخل خطيرا تهديدا الدولة وقد تنتقل هذه النزاعات إلى الدول الأخرى المجاورة لها في الوصف الجغرافي لما تخلفه هذه النزاعات من مأساة إنسانية تظهر صورتها بشكل واضح فقد بدأت الضرورة لتفعيل الحماية الإنسانية ونظرا لفئات المجتمع بوضع القواعد القانونية الملزمة لأطراف النزاع وبصرف النظر عمن هو المعتدي أو المعتدى عليه وجاءت هذه القواعد القانونية لتحدد الحد الأدنى من الحماية لكل فرد يعيش في ظل هذا النزاع المسلح وسبقت الشرائع السماوية قواعد القانون في حماية الإنسانية بصرف النظر عن العرق والدين واللون.
