إن الإسلام عقيدة وأخلاق وأحكام شرعية، وتنقسم الأحكام الشرعية إلى قسمين : الأول : الأحكام الشرعية القطعية الثبوت والدلالة، الثاني : الأحكام الشرعية الظنية الثبوت أو الدلالة. ويطلق على مجموع القسمين مصطلح (الفقه الإسلامي) الذي يعتبر المادة العملية في حياة الناس، إذ به تصحح العبادات، والمعاملات وسائر الأحوال التي يتعرض لها المسلم في حياته. ولقد لقى الفقه الإسلامي في مسيرته التشريعية عناية فائقة من علماء هذا الدين الذين أفنوا حياتهم في بناء قواعده وأصوله وفروعه، فكتبوا المتون والشروح والحواشي.
