قبل أن تصبح الدعوى الجزائية بين يدى القضاء للفصل فيها ينبغي أن تمر بمرحلة أولية هي مرحلة جمع الأدلة وتمحيصها ؛ ويطلق عليها عادة مرحلة التحقيق الأولي تمييزا له عن التحقيق النهائي الذي يجري أمام محكمة الموضوع في مرحلة المحاكمة. ولا يوجب القانون إجراء تحقيق ابتدائي بمعناه الضيق في جميع الدعاوى، بل يختلف الأمر بحسب ما إذا كانت الواقعة جناية أو جنحة أو مخالفة، فهو وجوبي في الجنايات قبل إحالتها إلى المحكمة، وجوازي في الجنح والمخالفات، ويجرى العمل على تحقيق الجنح المهمة فقط، وأما غير المهم منها وكذلك المخالفات، فإنه يتم التصرف فيها بناء على محضر الاستدلال المحرر بمعرفة مأموري الضبط القضائي؛ ودون أي تحقيق آخر.
