تمثل دعوى قطع النزاع الوسيلة الفنية لمواجهة المزاعم والإدعاءات والشائعات التي تثار حول حقوق الأفراد ومراكزهم القانونية خارج ساحة القضاء ؛ يستدعي ذلك الإيضاح مفهوم هذه الدعوى وتحديد طبيعتها وتمييزها عن غيرها من الدعاوى التي قد تختلط فيها. كما أن مخالفة هذه الدعوى لبعض أسس ومبادئ النظام القانوني قد أثار الخلاف حول قبولها، وهو ما يستدعي دراسة مسألة قبول هذه الدعوى، ويستدعي أيضا دراسة النظام القانوني لهذه الدعوى حال قبولها من حيث شروط قبولها والمحكمة المختصة بنظرها وكيف يفصل فيها وطبيعة الحكم الصادر في موضوعها. ولن تكتمل حلقات هذا البحث إلا بمعرفة مدى وجود تطبيقات لدعوى قطع النزاع في التشريعات الحديثة.
