يتحدث كتاب عن رقابة الامتناع على دستورية القوانين عن ماهية الرقابة على دستورية القوانين والرقابة القضائية على دستورية القوانين في الدساتير المقارنة حيث اقترن ظهور مشكلة الرقابة على الدستورية حديثا بنشأة الدساتير المدونة الجامدة في العالم تلك التي تمثلت أولاها في دستور الولايات المتحدة الأمريكية لعام 1787م ومن بعده الدستور الفرنسي لعام 1791 وسائر دساتير العالم الأخرى في القرنين التاسع عشر والعشرين كما تعاظمت تلك المشكلة مع زيادة حجم الدور التدخلي للدولة في الأعمال التشريعية كما في صورة القوانين المؤقتة.
