يوضح الكتاب إن الإنسان كائن اجتماعي بطبعه مما يعني أن ليس بإمكانه العيش منعزلا حتى ولا منفردا ولكنه يميل إلى الرغبة في العيش مع غيره والانتماء إلى وسط اجتماعي معين ومع ذلك فهو -بطبيعته- محب لأن يستأثر بأكبر قدر من الفوائد والمنافع وأن يتمتع بمساحة واسعة من الحرية حتى ولو كانت على حساب الغير، الأمر الذي يؤدي إلى اختلاف في المصالح وتضارب في المنافع وبالتالي إلى حدوث الخصومات والمنازعات ومن هنا كان ضروريا قيام كيان اجتماعي يحول دون نشوء التضارب ويتسم بالتوازن بين تلك المصالح.
