يشرح هذا الكتاب (عقد المقاولة) في القانون العراقي وفقا للمادة 864 من القانون المدني والتي تنص على أنه (المقاولة عقد به يتعهد أحد الطرفين أن يصنع شيئا أو يؤدي عملا لقاء أجر يتعهد به الطرف الآخر وفي هذا السياق يوضح المؤلف خصائص عقد المقاولة في القانون المدني العراقي، وأهميته في الوقت الحاضر وموقعه ويميزه عما يشتبه به من عقود أخرى فهو غير عقد البيع أو عقد العمل أو عقد الوكالة أو عقد الإيجار ثم يبحث في شروط صحته ومتى يتوجب فسخه، ويورد رأي فقهاء الشرعية به والحكم المستخلص من الشرعية الإسلامية في أحوال عقد المقاولة.
