يتناول المؤلف في كتابه هذا مبدأ المساواة في تولي الوظائف العامة في كل من دستور جمهورية العراق وفي قانون إدارة الدولة العراقي المؤقت للفترة الإنتقالية لتسير عليه أجهزة الدولة مؤقتا والدستور العراقي لعام 2005 الذي صدر في ظل الإحتلال الأميركي والذي لا يرقى في وجهة نظر المؤلف إلى مستوى دستور للبلد لكثرة الأخطاء والتناقضات فيه حيث تم الأخذ بالتنظيم الدستوري والتشريعي لهذا الحق.
