يعد الإختطاف من الجرائم الخطيرة التي تناولتها المنظومات القانونية المختلفة بالتجريم منها القانون العقوبات العراقي واللبناني والقانون الدولي لحقوق الإنسان وبينت الجزاء العقابي لها، في إطار سياسة تجريم تهدف لمحاصرة الجريمة والحد منها ووصلت في تشديد العقاب حد الحكم على الجناة بالسجن المؤبد أو بالإعدام في حال ما اقترن الفعل بظرف تشديد كالقتل ومن صور الخطف الفظيعة جريمة قتل الأطفال المخطوفين لأغراض غير مشروعة قرر التشريع الجنائي عقوبة الإعدام إلا أن المحاكم تقتضي بها ولا تنفذها مما يراها البعض عدم إنصاف مع التضحية وأهلها وتجاوز على حقهم في القصاص في حين يراها البعض عقوبة غير إنسانية تستوجب الإلغاء لمناقضتها حق الحياة الذي هو أحد حقوق الإنسان.
