إن قانون التنفيذ يهدف إلى صيانة حقوق الدولة والمواطنين وتيسير إجراءات التنفيذ وتربية المواطنين بروح التنفيذ الرضائي للأحكام والمحررات التنفيذية وإذا كانت المحاكم تتولى إصدار الأحكام والقرارات التي تضمن للناس حقوقها فإن لدائرة التنفيذ أهمية كبيرة في أنها تتولى تحصيل الحقوق التي قررتها تلك الأحكام والقرارات وتجعلها في متناول اليد ولأهمية قانون التنفيذ ولمساسه بحقوق الناس فقد عنيت بشرحه على المتون متناولا مواده بالشرح ومن ثم إيراد التطبيقات القضائية لها وتكمن أهمية هذه الطريقة في سهولة الرجوع إلى المادة وبيان مضمونها ومن ثم الإطلاع على التطبيقات القضائية لها وإثارة جملة من التساؤلات لإشكالات لم يضع لها القانون جوابا.
