يتناول الكتاب تعرض المرافق العامة في الدولة إلى ظروف طارئة غير عادية (إستثنائية) أثرت على أداء هذه المرافق في تأمين الخدمات العامة والحفاظ على النظام العام وحيث أن حاجات المجتمع بالإنتفاع بالخدمات أمر ضروري لا يمكن الإستغناء عنه وحيث أن مواجهة هذه الظروف بالوسائل القانونية أمر غير جدي في كثير من الحالات فكان لا بد من تجاوز بعض عناصر المشروعية لمواجهة هذه الظروف الإستثنائية فقد عمد القضاء والفقه إلى إبتداع نظرية قضائية تعمل على تطهير القرار الإداري من بعض التجاوزات الخارقة للقانون سمية بنظرية الظروف الإستثنائية.
