في هذا الكتاب يتناول المحامي محمد خير عمار شريف نطاق المسؤولية الخاصة في مقاولة البناء من لاتساع موضوع المسؤولية الخاصة (المسؤولية المعمارية) حاول المؤلف حيث الأضرار والأشخاص، ونظرا البحث في الأضرار التي تخضع لها هذه المسؤولية، وللأشخاص المسؤولين والمستفيدين منها بالأخص الأعمال والأضرار التي تشملها المسؤولية الخاصة في القانونين الأردني والفرنسي، فالقانون الأردني ضيق نطاق تطبيق المسؤولية الخاصة على التهدم الذي يصيب البناء أو المنشأ الثابت والعيب الذي يهدد متانة البناء وسلامته، في حين يرى المؤلف أن المشرع الفرنسي توسع بالنص على حالتين أخريتين وهما تطبيق تجهيزيا غير قابل للانفصال والعيب الذي يصيب أحكام المسؤولية الخاصة على العيب الذي يصيب عنصرا البناء أو المنشأ ويجعله غير صالح للغرض الذي أعد من أجله. لذلك سيتناول الكتاب الضمانات التي نص عليها المشرع الفرنسي وهما الضمانين السنوي والثنائي، وذلك بالإستناد على المقارنة بين القانون الأردني رقم (43 (لسنة 1976 ،والتشريع الفرنسي رقم (12 (لسنة 1978.
