نظرا للطبيعة القانونية الخاصة لنظم الحماية القانونية لغير كاملي الأهلية وتباينها من دولة إلى أخرى فقد أرتأينا في هذه الدراسة التعرض للمشاكل القانونية التي يثيرها ضابط الإسناد بهذا الخصوص في التشريع الأردني وذلك في ظل اعتناق المشرع الأردني لمبدأ شخصية القوانين فيما يتعلق بمسائل الأحوال الشخصية وقد لوحظ على هذا الضابط أنه ضابط تقليدي يعتمد على جنسية الشخص المشمول بالحماية لتحديد القانون الواجب التطبيق على المسائل الموضوعية في نظم الحماية القانونية الأمر الذي يعترض سبل تطبيقه مجموعة من المشاكل القانونية.
