تسعى هذه الدراسة لإعادة التفكير في مدى قدرة القانون الدولي على فض المنازعات الدولية اعتمادا على القوتين الخشنة والناعمة، وأهمية رد الاعتبار لعلم القانون وعلم السياسة وعلم الاجتماع والفلسفة وفق مقاربة متعددة الحقول المعرفية، لفهم نجاعة القانون الدولي أو عدم نجاعته، وبالتالي البحث عن الحلول غير المؤسسية في التنظيم الدولي، في ظل وجود تدافع كبير بين الفاعلين من أجل اقتناص الفرص والإمكانات المتاحة وتحقيق مصالح معينة على حساب مصالح أخرى.
