إن علم المقاصد مع قدمه في فقه أئمة الفقه واستنباطهم من جيل الصحابة رضوان لله عليهم إلى عصر الائمة المتبوعين إلى من جاء بعدهم من فحول الفقهاء في كل عصر إلا أن التنظير له ما زال مجال بحث ودرس وما زالت قواعده الدقيقة وقيودها محتاجة الى مناقشة وإنضاج وهو في حاجته إلى ذلك في العصر الحديث أحوج من غيره لخطورته أهمية في تجديد الاجتهاد الفقهي من جهة ومن جهة أخرى في حماية الاجتهاد الفقهي من التفلت من هداية الوحي باسم المقاصد أيضا. ولذلك فإننا لا نستغرب من كثرة البحوث والكتب والمناقشات والندوات التي تعقد لهذا الامر المهم.
