من المعروف أن مذهب الشافعي مر بمرحلتين اثنتين، عرفتا في تاريخ التشريع بمذهب الشافعي القديم، ومذهبه الجديد، وفي هذا المقال يواصل الباحث ما تم نشره في العدد العشرين من المجلة، وقد استهل المقال بالحديث عن مسألة التمييز بين أصول مذهبي الشافعي فيما يتعلق بمذهب الصحابي ؛ فقد ورد عنه في هذه المسألة ستة نقول. بعدها انتقل المقال إلى مسألة التمييز بين أًول مذهبي الشافعي فيما يتعلق بالاستصلاح، حيث وردعنه فيه ثلاثة نقول، ثم مسألة التمييز بين أصول مذهبي الشافعي فيما يتعلق برواية الأكثر؛ حيث يؤثر عنه نقلان متفرعان في هذه المسألة.
