تناول الكتاب عناية التشريع الإسلامي واهتمامه بأمر الأسرة وأحكامها منذ اللحظات الأولى لتكوينها، ومن تمام التشريع عدم قصر اهتمامه على ما ينشئ تلك العلاقة بل يمد اهتمامه لما ينهيها أيضا لأن العقد له من الظروف والأحوال ما يستدعي حتما إنهاؤه وأحتل الطلاق المقام الأول في البحث نظرا لأنه الطريق الطبيعي لإنهاء العلاقة الزوجية، ومن خلال هذه النصوص الشرعية نجد أن الشرع رسم طريقا معينا للطلاق، وقصد به تحقيق مقاصده في العلاقة الزوجية. وإتبع فضيله الشيخ في هذا الكتاب منهج الدراسة المقارنة بين المذاهب الفقهية مع ذكر أدلة كل مذهب منها ومناقشة هذه الأدلة.
