لقد ظهر مصطلح الجرائم المستحدثة كنتيجة للتغيرات في البنى الاجتماعية والاقتصادية للمجتمعات الحالية، فمن الناحية الاجتماعية فإن تغير منظومة الأعراف والقيم الاجتماعية وتحولها من المحلية إلى العالمية (العولمة)، قد ولّد سلوكيات جديدة (منحرفة ومجرمة خارج سياق القانون الوطني)، أما من الناحية الاقتصادية، فإن عولمة المال والاقتصاد الناجمة عن زيادة الترابط الإلكتروني والاعتمادية المتزايدة على التقنية والاتصالات في تسيير الاعمال الاقتصادية وما نجم عن ذلك من مؤسسات وشركات متعددة الجنسيات (وشركات عابرة للحدود الوطنية) قد اسهمت في بروز جرائم اقتصادية مستحدثة.
