تناول الكتاب إن العدالة الجنائية معروفة عبر التاريخ الإنساني، حيث إن الجاني دائما يعاقب على الجرم الذي اقترفه، فالعقاب يختلف من جريمة إلى أخرى ومن دولة إلى أخرى وفقا للنظام العقابي الذي تتبعه، حيث إن الهدف من العقاب هو مكافحة الظاهرة الإجرامية والحد منها وردع المجرمين وإصلاحهم وتحقيق العدالة في المجتمع، فالعقوبة إذا كانت سالبة للحرية وهي الحبس أو كانت مالية متمثلة بالغرامة أو بالعقوبتين معا، ولكن بعد التطور العلمي والصناعي والثقافي والاقتصادي وزيادة عدد السكان أدى ذلك إلى زيادة معدلات الجريمة وكذلك إلى اختلاف أنواع الجرائم واختلاف الوسائل التي تنفذ بها، مما أدى إلى زيادة أعداد المحابيس وتكدس الحبس، مما نتج عنه آثار سلبية ومساوئ كثيرة من العقوبات السالبة للحرية.
