Overview
الزم القانون المدني العراقي، كقاعدة عامة، المدين بتنفيذ التزاماته تنفيذا عينيا كلما كان ذلك ممكنا. فأذا نفذ المدين التزامه فلا توجد، والحالة هذه، أية مشكلة ويسمى التنفيذ في هذه الحالة بالتنفيذ العيني الاختياري. اما في حالة امتناع المدين عن تنفيذ التزامه، مع إمكانية تنفيذ هذا الالتزام وعدم وجود نص قانوني يمنع التنفيذ، ففي هذه الحالة تنشأ المشاكل والمنازعات بين طرفي العقد بشكل عام. فيضطر الدائن إلى مراجعة دائرة التنفيذ لاجبار المدين على تنفيذ التزامه تنفيذا عينيا متى كان لديه سند أو قرار قضائي مكتسب درجة البتات. والتنفيذ في هذه الحالة يسمى بالتنفيذ العيني الجبري وهو الذي يهمنا وهو موضوع بحثنا.
