هذا الكتاب نظرة معاصرة تشير إلى أن الشريعة الإسلامية لم ولن تبتعد عن مبادئ التحكيم المستقرة في الضمير الإنساني ومنها الإحالة إلى مبادئ العدل والإنصاف وان فقه الاجتهاد الجماعي المعاصر لم ينجح في تقديم نظرية واضحة في التحكيم حيث قيد نفسه بقيود لم يعد لوجودها سبب وذلك على ما يبدو بسبب عدم استيعاب آليات التحكيم الحديثة وان المشرع السعودي أيضا تأثر ببعض اعتبارات فقه السلف خاصة فكرة الولاية القضائية مما جعل نظام التحكيم السعودي صالحا لحكم العلاقات الداخلية ولكنه لا يصلح للتحكيم في العلاقات الخاصة الدولية كما يتحدث هذا الكتاب عن أن الإحالة إلى الشريعة الإسلامية كقانون مطبق على النزاع لا يمكن أن يكون شرطا مقبولا وخاصة في العلاقات الخاصة الدولية إلا بالوفاء باستحقاقات على مستوى الفقه والقضاء وأما أولى الاستحقاقات على مستوى الاشتراع فهي تقنين نظام المعاملات الإسلامية لتتضح معالم النظام العام الإسلامي بالنسبة للآخر.
