يتناول كتاب (آثار عقد الفاكتورينغ، عقد شراء الديون التجارية) والذي قام بتأليفه (مصطفى تركي حومد الجوراني) في حوالي (159) صفحة من القطع المتوسط موضوع (العقود التجارية) مستعرضا المحتويات التالية كان لا بد من وجود دراسة تبحث في الإطار القانوني لهذا العقد، وتحدد طبيعته القانونية، فطرحت الدراسة هذه بهذا الخصوص عدة أنظمة قانونية في إطار القانونين المدني والتجاري، كنظام حوالة الحق، ونظام الوكالة، ونظام خصم الأوراق التجارية، ونظام تجديد الدين، وتبين أن الأنظمة المذكورة تتشابه مع عقد الفاكتورينغ في جوانب إلا أنها تختلف عنه في جوانب أخرى عديدة، وتبنت الدراسة هذه النظرية الحلول الاتفاقي (الحلول مع الوفاء) إطارا قانونيا للعقد، إضافة إلى وضع الحلول القانونية الملائمة لتمكين المؤسسة المالية عند تزاحمها مع الغير في استيفاء الدين. وقد خلصت هذه الدراسة إلى مجموعة من النتائج في طليعتها، حث المشرع العراقي والأردني إلى ضرورة إفراد نص قانوني لعقد الفاكتورينغ، وإنشاء ودعم المؤسسات المالية التي تعمل بهذا النظام، لما له من مردود إيجابي على الاقتصاد الوطني.
