فى هذا الكتاب ستعرف تاريخ تأسس القانون الدولي للبحار عن طريق العرف الدولي، حيث كان النظام الإقليمي تحكمه ثلاث إعتبارات عرفية، السيادة الوطنية والملك المشاع والملك المباح. وقد وصفت السيادة بأنها نوع من الإختزال القانوني للشخصية القانونية (الدولة)، أما نظام الملكية المباحة فيتسم بعدم وجود سيادة عليه ولا فائدة من تملكه في منطقة أو كائن متحرك ومع ذلك تبقى متاحة من قبل أي شخص يدعي ملكيتها.
