العقوبة في ذاتها أذى ينزل بالجاني زجرا له، فهي من الناحية الذاتية ضرر في ظاهرها، فقتل رجل قاتل هو أذى له. فكل العقوبة في ذاتها أذى ينزل بالجاني زجرا عقوبة في ذاتها أذى لمن وقع عليه العقاب، ولا يخلو ذلك من أذى للأمة في ذاتها، ولكن قانون المصلحة والمفسدة يحتم إنزال العقاب به، لأنه صار مصدرة أذى للأمة أو لكل من يتصل به، فالقاتل أنزل أذى للأمة كلها، ولو ترك من غير عقاب.
