المنافسة هي روح التجارة وهي محك الحريات الاقتصادية للأفراد والجماعات، وهي التي تخلق أسبابا تؤدي إلى الوفرة الإنتاجية لدى المجتمع وتحسين جودته، لكن هناك منافسة غير مشروعة بسرقة حقوق الملكية أو تزيفيها أو تقليديها وتكون هنا محلا للدعوى الجنائية، وبالطبع تختلف أساليب المنافسة في الدول المتقدمة عن المنافسة في الدول النامية والأمثلة في ذلك كثيرة مثل المنافسة في صناعة السيارات والتكنولوجيا، وللمنظمات الحقوقية موقف واضح من المنافسة وحقوق الملكية، وقامت مصر بإعداد مشروع قانون لحماية الملكية الفكرية باعتبارها أحد الدول النامية بشأن المعلومات غير المفصح عنها وفقا للتريبس.
