يتحدث الكتاب عن الجريمة والعقوبة التأديبية حيث إن المجتمع الإدارى كغيره من المجتمعات قائم على العلاقات بين الأفراد بعضها ببعض من جهة وعلاقتهم بالجهة الإدارية من جهة أخرى وتلك العلاقات تقوم على سلوك الفرد من هذا السلوك ما هو قويم يتفق مع القانون ومنه ما هو اعوج يخالف القانون ذلك الاخير هو ما يشكل الجريمة التأديبية والتي هى نظرا لطبيعة القانون الإدارى غير محددة على سبيل الحصر بخلاف الحال فى الجريمة الجنائية الأمر الذي يجعل على عاتق الهيئات القضائية المسند إليها تتبع الجريمة التأديبية مهمة تقييمها لتحديد ماذا كانت تلك الافعال تشكل جريمة تأديبية من عدمه قبل ان تشرع فى تقدير العقوبة التأديبية المناسبة لها.
